Terms of Service

1. This agreement

Please read section 24 (Disputes). It requires most disputes between you and Sealed to be resolved by binding individual arbitration instead of in court, and you give up the right to a jury trial and to take part in a class action. You can opt out of arbitration within 30 days of first accepting these Terms, as section 24.3 explains.

1.1 Who we are. Sealed is operated by Sealed Collectibles, Inc., a Delaware corporation with its principal address at 5794 Bird Rd, Unit 577, Miami, Florida 33155 ("Sealed", "we", "us"). Sealed runs the website at sealed.live and the services described in these Terms.

1.2 What these Terms cover. These Terms are the agreement between you and Sealed for your use of the site and everything on it: your account, Seals, Cash, packs, your vault, the marketplace, the auction house, the trading board, breaks, the shop, levels and bounties, referrals, and the community features. The Privacy Policy and the Official Rules of the sweepstakes are part of this agreement. If these Terms and the Official Rules disagree about the sweepstakes, the Official Rules control.

1.3 Accepting them. You accept these Terms when you create an account, and again each time you use the site after they change. Creating an account requires checking a box that reads: "I accept the Terms of Service, the Privacy Policy and the Official Rules." Checking it is recorded with the version you agreed to.

1.4 You must be 18. You may create an account and use Sealed only if you are at least 18 years old and live in a place where using it is lawful. You tell us your date of birth when you sign up, and an account whose date of birth shows it is under 18 is closed to everything on the site. Identity verification is required before money can leave the platform (section 5), and before any single purchase of Seals of $500 or more.

1.5 Where Sealed is available. Sealed is offered to residents of the United States. We may refuse or restrict service in any place where the law makes it necessary.

2. Words used in these Terms

  • Seals — the platform currency. You buy Seals with money and spend them on the site. One Seal is worth one cent for everything on the site, and 100 Seals are sold for $1.00. Seals are never paid out as money.
  • Cash — a balance in US dollars that you earn only by selling a card on the site. Cash can be withdrawn to your bank account or converted into Seals.
  • Pack — a set of specific collectible trading cards, arranged in tiers, from which one card is revealed to you when you open the pack, at odds that are published on the pack's page.
  • Pull — the card revealed by one opening of a pack.
  • Card — a specific physical collectible trading card. A graded card is identified by the certification number on its slab; an ungraded card is identified by its description.
  • Vault — the record of the cards you own on Sealed.
  • Market value — the value Sealed holds for a card, obtained from a licensed pricing provider or, for some cards, set by Sealed itself, and checked again from time to time. It is Sealed's working figure, not a valuation you can rely on (section 7.4).
  • Sweepstakes — the promotional sweepstakes described in the Official Rules, in which entries are earned as described in section 14 and, equally, by the free method of entry. No purchase is necessary.

3. Your account

3.1 One person, one account. You may hold one account. An account is personal to you; you may not sell, lend, share or transfer it, and you may not create or use an account for somebody else. We may close every account that belongs to one person if that person holds more than one.

3.2 Sign-in and security. Sign-in is handled by our identity provider. You are responsible for keeping your sign-in method secure and for everything done from your account. Tell us at once through Support if you believe somebody else has used it. Before Support restores access to an account, it may ask you to confirm the email address on the account and details of recent activity on it, and to complete an identity check.

3.3 Your username. A username is 3 to 20 letters, numbers or underscores and must start with a letter or number. Names that read as belonging to Sealed, its staff or the sweepstakes are reserved. We may change a username that impersonates somebody, is offensive, or infringes a right.

3.4 Your profile. You choose whether your profile is private, visible to friends, or public, and which parts of it are shown. Your username, avatar, level and border are visible to other members wherever you act on the site, for example on a listing, in a break or in chat.

3.5 True information. Everything you give us has to be accurate, and you have to keep it current. Giving a false date of birth, or false information to our payment provider, is a breach of these Terms and grounds to close the account.

4. Seals

4.1 What Seals are. Seals are a limited license to use the features of the site that are paid for in Seals. Seals are not money, are not property, have no value outside the site, earn no interest and cannot be redeemed for cash from Sealed. Seals can never be converted into Cash or paid out. The site has no function that does it.

4.2 Buying Seals. Seals are sold through our payment provider, Stripe, at 100 Seals per $1.00. The minimum purchase is $5.00. The maximum is $7,500 in a single purchase and $7,500 in any rolling 24-hour period. A checkout you start holds part of that allowance for 30 minutes. The Seals you receive are credited from the amount Stripe reports as paid; nothing you send from your browser can change the number.

4.3 No refunds. Because Seals are a license you can begin using at once, a purchase of Seals is final and non-refundable, except where the law requires a refund or where we choose, at our discretion, to make one. If a purchase is refunded, reversed or disputed with your bank, the Seals it bought are removed from your account, and if they have already been spent your balance may go negative until it is repaid.

While your balance is negative you cannot spend Seals; buying Seals or converting Cash into Seals repays it. If a dispute is decided in Sealed's favor, the Seals are restored.

4.4 Seals do not expire while your account is open.

4.5 Seals move only inside the site. You cannot send Seals to another member as such. Seals do change hands when a member pays you in Seals for a card you sold, and when a trade you both accept includes Seals. Those are the only ways.

4.6 Every Seal you buy earns entries in the sweepstakes running at the time, as section 14 and the Official Rules describe. Entries are earned when you buy Seals; spending them earns none. If a purchase is refunded or successfully disputed, the entries it earned are withdrawn, unless the sweepstakes period has already ended.

4.7 When your account closes, any Seals remaining are forfeited without payment, except as section 18 says.

5. Cash

5.1 How Cash is earned. Cash is earned in exactly three ways, all of them sales: selling a card to another member on the marketplace for a Cash payout; selling a card at auction for a Cash payout; and selling a card to Sealed through the marketplace's quick-sell option, which pays 80% of the card's market value in Cash. No Cash is ever produced by opening a pack, by a break, by a trade, by a bounty, by the sweepstakes, or by any other chance-based feature.

5.2 Fees on sales. Sealed keeps a fee of 10% of the sale price on every marketplace and auction sale. You receive the rest, in Seals or Cash as you chose when you listed the card.

5.3 The 14-day hold. Cash from a sale can be withdrawn or converted 14 days after the sale, so that a problem with the card on the buyer's side can surface first.

5.4 Withdrawing Cash. Withdrawals are paid through Stripe Connect. Before your first withdrawal you complete Stripe's onboarding, in which Stripe collects your identity, tax information and bank details directly. Sealed never sees or stores your bank account or identity documents. Stripe may decline to onboard you, and we cannot pay you out if it does. Sealed charges no fee for a withdrawal. The minimum withdrawal is $20.00; you may withdraw up to $2,000.00 in any rolling 24-hour period; a withdrawal of $500.00 or more is reviewed by a person before it is sent. A withdrawal that Stripe reverses is returned to your Cash balance.

5.5 Converting Cash into Seals is free, at $0.01 per Seal, subject to the 14-day hold. Converting earns no sweepstakes entries. Conversion is one-way: Seals never become Cash.

5.6 Taxes. You are responsible for any tax on money you receive. Stripe issues the tax forms that apply to payouts. Sealed may be required to report or withhold as the law directs.

6. Packs and pulls

6.1 What a pack is. A pack is a set of specific, individually identified collectible cards arranged in tiers. Opening a pack reveals one of them to you. The odds of each tier, and of every card in it, are published on the pack's page before you buy. Within a tier every card has the same chance.

6.2 Contents rotate. The cards in a pack change as they are pulled and replaced, and every card in a tier is within the value range Sealed sets for that tier. A card you saw in a pack earlier may no longer be in it. On packs whose odds are worked out from the cards standing in them, the odds move as the cards change; the page always shows the odds in force, and every opening is recorded against the odds in force at the moment it happened.

6.3 How a pull is decided. The card is decided on our server, inside the transaction that charges your Seals, from a server seed we committed to before you could open anything, a seed of your own that you may set, and a running counter. Nothing you do in your browser, and nothing anybody else does, changes which card you get. The exact method is published on the Verify page, and you can check any pull, including somebody else's, using only public information. When you retire your seed we reveal it in full so every pull it decided can be replayed. You cannot retire a seed while you hold a bought pack you have not yet opened.

6.4 The reveal is decoration. The card is fixed before the reveal animation starts. Lights shown before the last one are chosen at random by your browser from other tiers and mean nothing; only the final result is the pull.

6.5 Buying and opening. When you buy a pack, its Seals are charged and its card is held for you until you begin the reveal, or for five minutes, after which the pack is placed unopened in your vault. A pack, once bought, cannot be refunded. An unopened pack in your vault can be opened at any time.

6.6 When we refuse to sell. Sealed will not sell a pack that cannot be filled, or one whose contents at that moment are out of balance with what Sealed has set the pack to return. If that happens the sale is refused before anything is charged, and a break in progress is called off with every slot's Seals returned. The odds in force for every pack are always the ones on its page. A refused sale is not an error in your favor or against you; it is the pack being taken off sale until it is restocked.

6.7 Demo openings spend nothing, give you nothing, and earn no entries.

6.8 What a pack is not. A pack is a purchase of a collectible card at published odds. The cards in a pack are collectible items, not prizes. Opening more packs does not change the odds of any pack, and does not change your chance in the sweepstakes at all. Entries are earned when you buy Seals, not when you spend them, so opening a pack earns none.

6.9 Free packs. Sealed may offer packs at no charge. Today there are two kinds: a welcome pack, which each member may open once, and daily free packs, which are unlocked by reaching a level (see 15) and of which you may open one a day, whichever unlocked pack you choose. If you try to open your daily free pack while it is restocking and cannot open one before the end of that day, an extra daily free pack is added to your account, to be opened on a later day, one extra a day at most. A welcome pack that is restocking stays waiting for you until it can be opened. No purchase is required to open a free pack, and a free pack earns no sweepstakes entries. A free pack is otherwise a pack like any other: its odds are published on its page, the card you pull is yours, and everything in section 7 about your vault applies to it. Free packs may be changed, limited or withdrawn at any time, and we may refuse one where we reasonably believe accounts are being made to collect them.

7. Your vault and the cards in it

7.1 What you own. When you pull a card or buy one, you own that specific card: for a graded card, the one with that certification number. It is recorded in your vault, and you may keep it there, sell it, auction it, trade it, exchange it, or have it shipped to you (section 7.7).

7.2 Where the card is. Sealed does not hold the cards in its own inventory. A card in your vault is a specific card that a supplier holds for sale and that Sealed has arranged to buy for you when you ask for it to be shipped. When you withdraw a card it is bought from that supplier and shipped by the supplier directly to you. Until then it stays where it is, and your vault records your right to it.

7.3 Selling a card back to Sealed. At any time you may sell a card in your vault back to Sealed for 90% of its market value in Seals. On the marketplace listing screen you may instead sell it to Sealed for 80% of its market value in Cash. A card sold back may be offered to other members again.

7.4 Market values. The market value shown for a card comes from a licensed pricing provider or, for some cards, is set by Sealed itself. The value of a card in your vault is checked with the provider again from time to time and may move up or down. It sets the sell-back price, the exchange credit and the price band a card may be listed in. Market values are not given as financial advice, may not be accurate, and can change at any time. A card's value can fall as well as rise while it is in your vault, and Sealed owes you nothing for a change in value.

7.5 Identification. Sealed identifies a graded card by the certification number its supplier reports and identifies and values it through a licensed provider. If a card turns out to have been misidentified, Sealed will replace it with a copy of the card it was described as, at the same grade, or if none is available offer the choice in 7.6, measured against the value of the card as described.

7.6 If a card expires before you withdraw it. The specific card in your vault may become unavailable before you withdraw it. If it does:

  1. Same card, same grade. We replace it with another copy of the same card, the same year, set and grade, which for a graded card carries a different certification number, or for an ungraded card another ungraded copy. The card stays in your vault as it was, and a listing or trade you made for it carries on. We tell you when this happens.
  2. If no copy is available, we keep looking, and in the meantime you choose: exchange the card for any other card available on Sealed with its market value plus an extra 10% counted toward the card you take (the extra 10% can only be spent on a card, never paid out); or sell it back to Sealed for 100% of its market value in Seals, with no deduction. The market value is the value as it stood when the card expired.
  3. While it waits the card stays in your vault but cannot be listed, auctioned or traded, and any listing, auction, trade post or offer resting on it is canceled.
  4. Choosing. You may choose at any time, and if we find a copy first it replaces the expired card and no choice is needed. There is no deadline: until you choose or we find a copy, the card waits in your vault as item 3 above describes.

7.7 Withdrawing a card (shipping). You may ask, from your vault, for up to 20 cards at a time to be shipped to you. A card that is listed, at auction, named in a trade or expired cannot be shipped until it is free. When you ask for a card to be shipped, Sealed buys it from its supplier and the supplier ships it to the address you give, which must be a United States address with a name, street, city, state and ZIP code. You pay shipping and handling, charged separately to your payment card in dollars, outside both Seals and Cash, and it cannot be paid from a balance. Shipping is the supplier's own postage rate to your address. Handling covers what it costs Sealed to have that order fulfilled to your address, which is mainly the sales tax the supplier charges Sealed on the purchase. Sealed adds no markup to either, and you are quoted both figures and the total before you pay; a quote is good for 15 minutes. The quote is a fixed price. You pay what you were quoted, never more, and it is not adjusted afterward if the supplier's final charges for the order come in higher or lower. Sealed is not registered to collect sales tax and collects none from you; handling is a charge by Sealed and not tax. Cards held by the same supplier ship together as one parcel. You are never asked for more than you were quoted. Shipping is within the United States only. You may cancel a request until you have paid for it; once it is paid it cannot be canceled. From the moment you go to pay, the cards in the request cannot be listed, auctioned or traded. If Sealed cannot fulfill a paid request, the cards return to your vault and the shipping and handling you paid for them is refunded to your card. When a card ships, the carrier and tracking reference are shown in your vault. A card that has been delivered leaves your vault and everything in these Terms about vaulted cards stops applying to it.

Problems with a shipped card.

  1. No returns for a change of mind. A card that was shipped to you as requested cannot be sent back because you no longer want it. Selling a card back to Sealed (section 7.3) is available only while the card is in your vault.
  2. Wrong or damaged card. If the card delivered is not the card in your vault (a different card, grade or certification number), or it arrives damaged (a cracked slab, for instance), tell Sealed within 7 days of delivery and include photos of the card and the parcel. Sealed will send you a prepaid return label; ship the card back with it within 7 days of receiving it. A claim may be declined if the card is not shipped back in time.
  3. Lost parcel. If your parcel has not been delivered within 7 days after its latest estimated delivery date, tell Sealed within 21 days after that date. Nothing needs to be returned.
  4. What Sealed does. For a wrong, damaged or lost card, Sealed first replaces it with another copy of the same card, the same year, set and grade (as in section 7.6), and ships it to you at no charge. If no copy can be found, Sealed instead pays you 100% of the card's market value on the day you reported the problem, in Seals or Cash as you choose (a card pulled from a free pack is paid in Seals only), and refunds the shipping and handling you paid for that card.
  5. After delivery. Once tracking shows a parcel delivered to the address you gave, it is your responsibility. Sealed does not replace or pay for a parcel that tracking shows as delivered.

7.8 Appreciation. A card's market value may rise between the pull and the withdrawal. If, when you ask for a card to be shipped, no supplier has a copy at or below the value Sealed holds for it, we keep looking for one at that value, and in the meantime the choices in 7.6 are yours on the same terms: exchange it, with the extra 10%, for another card, or sell it back to Sealed for 100% of that value in Seals.

8. The marketplace

8.1 Listing. You may list a card from your vault for sale to other members at a price in Seals between 70% and 130% of its market value, and choose whether to be paid in Seals or in Cash. You may change the price or cancel the listing at any time before it sells. Listing a card cancels any trade post or offer that rests on it.

8.2 Buying. The buyer pays the listed price in Seals, read from the listing itself at the moment of purchase. A purchase is final: the card moves to the buyer's vault and the price, less the 10% fee, is credited to the seller. Buying a card earns no sweepstakes entries; entries are earned only when Seals are bought (section 14).

8.3 Sellers are pseudonymous. A listing shows the seller's username and avatar and nothing else about them.

8.4 Quick sell. The listing screen also offers to sell the card to Sealed for 80% of its market value in Cash (section 7.3).

8.5 Watchlist. You may watch a listing. A listing shows how many members are watching it, never who.

8.6 Sealed as a seller. Sealed may list cards it holds for sale on the marketplace, as a seller named Sealed. A card bought from Sealed is a vault card like any other, subject to sections 7 and 8, and Sealed keeps the whole price. Sealed never lists under another name and never bids on or buys its own listings.

9. The auction house

9.1 Creating an auction. You may auction a card from your vault for one, three or seven days, with an opening bid between 50% and 80% of the card's market value and an optional reserve, hidden from bidders, between the opening bid and the bid ceiling. You choose Seals or Cash as your payout.

9.2 Bidding. Bids are in Seals. No bid may exceed 150% of the card's market value. Each bid must exceed the current bid by at least 100 Seals or 2%, whichever is greater. You bid by naming a maximum, and the auction bids for you up to it; your maximum is never shown to anyone. A bid is binding and funded: your whole maximum, not just the current bid, is held from your balance the moment you bid, and is released only if you are outbid or the auction ends unsold. If you take the card, you pay the price the auction ended at, and the rest of your maximum is released.

9.3 Ending. A bid placed inside the last five minutes extends the auction to five minutes from that bid. When the auction ends, the highest bid at or above any reserve takes the card; the buyer's held Seals are spent and the seller receives the price less the 10% fee. If the reserve is not met the auction ends unsold, the card stays with the seller, and every hold is released in full. Paying for an auction earns no sweepstakes entries.

9.4 Cancellation. A seller may cancel an auction only while it has no bids. Once anybody has bid, the auction runs to its end.

10. The trading board

10.1 What it is. The trading board is where members offer cards, and optionally Seals, to each other. Nothing on it is priced by Sealed, nothing is reserved by posting, and Sealed takes no fee on a trade.

10.2 Posts and offers. A post advertises what you have and want; it reserves nothing, and the cards named stay yours to sell or list until you accept an offer. Seals offered are held from the offerer's balance. You may have up to 10 open posts, up to 12 cards on each side of a trade, and up to 3 unanswered offers waiting with any one member. Offers expire after seven days.

10.3 Accepting. When both sides accept, the cards and any Seals move at once and the trade is final. Selling, listing, auctioning or shipping a card you promised in a trade cancels that trade. Seals in a trade move between members rather than being spent, so a trade earns no sweepstakes entries.

11. Exchange

You may hand up to 20 cards from your vault back to Sealed and take another card in their place. Cards you hand back are credited at 90% of their market value; a card taken from Sealed's own stock is charged at 100% of its market value, and a card taken from another member's listing at that listing's price. An exchange in which any card has no market value is refused. An exchange earns no sweepstakes entries.

12. Breaks

12.1 What a break is. A break is two to four slots opening packs together and dividing the cards between them. The member who starts a break chooses the packs, from one to twenty, one for each round; how many slots there are; which slot is theirs; and how the cards are dealt (12.3). Each round, one pack of that round's kind is opened for every slot, the round's cards are ranked by market value, and every slot is dealt exactly one card each round. Nobody wins or loses a break: every slot leaves with as many cards as there were rounds.

12.2 Every pull is an ordinary opening. Every pack in a break is opened at its published odds and recorded in the fairness log like any other opening. A break's pulls are decided on a seed that belongs to the break: it is committed when the break is created, combined with the seated members' own seeds when the break runs, and revealed when the break ends, so any pull in it can be checked afterwards. The break adds no chance of its own beyond the packs' odds.

12.3 How the cards are dealt. The member who starts a break picks one of two ways before anybody joins:

  • Ranked — slot 1 is dealt each round's most valuable card, slot 2 the next, and so on down, in the same order every round.
  • Snake — the same on the first round, then reversed every other round, so the last slot is dealt the most valuable card on the second round.

Two cards of equal value go to the lower-numbered slot first.

12.4 Slots and price. You may take one slot in a break. Each slot has its own price in Seals, set by Sealed when the break is created, from what that slot's place in the order can be expected to be dealt; the prices of all the slots together equal the price of all the packs the break opens. A slot's price is shown before you take it. The price shown while you are building a break is a quote and is worked out again when the break is created. The Seals for your slot are set aside from your balance when you create or join the break, and are spent when it runs.

12.5 If a break does not fill. A break that has not filled 30 minutes after it was created closes, and every slot's Seals are returned in full. Until the last slot is taken, the member who started it may call it off, and anybody else may give up their slot, with their Seals returned in full. Once the last slot is taken the break runs, and a slot can no longer be given up. If a pull in a running break is refused (section 6.6), the whole break is undone: nothing is opened and every slot's Seals are returned.

12.6 House slots. If a break has not filled, the member who started it may fill every open slot with house slots run by Sealed, and the break then runs at once. A house slot pays nothing. Its packs are opened from Sealed's stock at the same published odds, its cards are ranked and dealt with everybody else's, and whatever a house slot is dealt goes back into Sealed's stock. House slots appear in the break under house names with a bot picture.

12.7 What you take away. The cards dealt to your slot go into your vault when the break's replay finishes, and are yours like any other card you pull (section 7). A break earns no sweepstakes entries and no experience points. You may have up to three breaks waiting to fill at a time. Free packs and limited packs cannot be opened in a break.

13. Grading

Sealed does not currently offer a grading service. Cards cannot be sent from a vault to a grading company through the site.

14. The sweepstakes

14.1 No purchase necessary. Sealed runs a promotional sweepstakes governed by its Official Rules. No purchase is necessary to enter, and a purchase does not improve your chances of winning. There is a free method of entry, described in the Official Rules, whose entries count exactly the same as entries earned on the site and are drawn on identical terms.

14.2 Entries earned on the site. Every Seal you buy during a sweepstakes period earns entries at the rate stated in the Official Rules, which is one entry for every whole $1 paid for Seals. Spending Seals earns no entries, whatever you spend them on: opening a pack, a slot in a break, buying a card on the marketplace or at auction, an exchange and a shop order all earn none. Converting Cash, trading, free packs, bounties and referral rewards earn none either. Entries belong to the period in which they were earned and do not carry over.

If a purchase is refunded or successfully disputed, the entries it earned are withdrawn in proportion to the amount returned. Entries are not withdrawn once the period they belong to has ended, because the drawing list for a closed period is a record of what was drawn from.

14.3 The drawing. The winner is drawn at random from all eligible entries, by the administrator and in the manner the Official Rules set out. Entries earned on the site and entries from the free method are drawn together, on identical terms.

14.4 Nothing else affects it. Your level, your border, your bounties, your referral rewards, the packs you choose, and the cards you pull have no bearing on the sweepstakes.

15. Levels and bounties

15.1 Levels. You earn experience points in two ways: for Seals you spend opening packs, buying a card on the marketplace, and paying for an auction you have taken, at one point per Seal; and by completing bounties (15.2). Nothing else earns points: not buying Seals, not a slot in a break, not an exchange, not a shop order, not trading and not selling. Points accumulate into levels over a season, and each level unlocks a profile border. Some levels also unlock a daily free pack (see 6.9); you may open one free pack a day whatever you have unlocked. Every reward at a level is the same for everyone who reaches it. Levels reset each season; what you reached stays on your profile. Levels have nothing to do with the sweepstakes: they earn no entries and change no odds. The point rate, the ladder and the rewards may change; a change applies from when it is made.

15.2 Bounties. Bounties are tasks on the site — for example, opening a pack today, or pulling cards from several categories in a week or a season. Each bounty shows what it asks and how many experience points it pays, and when you have done what it asks you claim the points. A bounty can be claimed once in the day, week or season it runs for. Bounties pay experience points and nothing else: no Seals, no Cash, no cards and no sweepstakes entries. Bounties may be added, changed or withdrawn at any time.

16. Referrals and creators

16.1 Bringing a friend. Every member has a referral link and code. A new member who signs up through your link is attributed to you, once, if they arrive within the attribution window. When referral rewards are switched on, both of you receive Seals once the new member makes a first purchase of at least the stated minimum, up to a stated number of rewarded referrals per member. The current amounts are shown on your Bring a friend page. Referral rewards are switched off today. Referring yourself, an account you control, or an account in your household is forbidden, and a reward obtained that way is void. Referral rewards earn no sweepstakes entries, and Seals from a reward earn none when they are spent, like any other Seals.

16.2 Creators. Sealed's creator program is invite-only and is governed by a separate creator agreement. A creator earns a share of the profit Sealed makes on members they bring, paid outside Sealed. A creator is never paid in Seals or Cash on the platform.

17. Conduct

17.1 What you may not do. You may not:

  • use Sealed if you are under 18, or help somebody under 18 to use it;
  • hold more than one account, or use somebody else's;
  • move money between accounts you control by listing and buying cards, or otherwise use the marketplace, auctions or trades to disguise a transfer;
  • interfere with a pull, a break, an auction or the fairness log, or attempt to; probe, scrape, overload or reverse-engineer the site;
  • use bots, scripts or automation to act on the site;
  • harass, threaten, impersonate or defraud anybody, or post anything unlawful, hateful or sexually explicit in chat, messages, a profile or a listing;
  • arrange a sale, trade or payment outside the site with somebody you met on it;
  • chargeback a purchase you made and used;
  • use Sealed for anything unlawful.

17.2 Chat and messages. Public chat and direct messages are visible to other members and to Sealed. We may remove a message. Blocking a member hides you from each other everywhere on the site.

You may report a member, a chat message, a listing, an auction, a trade post or a trade offer to Sealed from the place it appears, with a reason. A report goes to a person at Sealed to look at; it has no automatic effect on anybody, and we do not promise to tell you the outcome. You may not report yourself, and you may not use reports to harass somebody.

17.3 Enforcement. We may warn you, remove content, restrict features, suspend your account, or close it, for a breach of these Terms or where the law requires. While an account is suspended you are told why, and you can still sign in, withdraw your Cash and contact Support, but you cannot use the rest of the site. Suspension takes nothing from you: no card is sold and no Seals are forfeited, and if the suspension is lifted everything is as it was. Section 18 says what happens to your balances and cards when an account is closed.

18. Closing an account

18.1 By you. You may close your account in Settings. Before it closes we show you exactly what will happen to your Seals, your cards and your Cash, and you confirm by checking a box and typing your username. Closing happens at once and cannot be undone.

18.2 By us. We may suspend or close your account for a breach of these Terms, for suspected fraud, where a payment is reversed, where our payment provider requires it, or where the law requires it.

18.3 What happens to what you hold. When your account closes, for any reason:

  • Cards in your vault are sold to Sealed at that moment at the quick-sell Cash rate, 80% of each card's market value, and the proceeds are added to your Cash. Your open listings, trade posts and trade offers are canceled first, along with any auction that has no bids. An auction that already has bids runs to its end, and if it sells the proceeds are added to your Cash. Cards in a shipment you have already paid for are not sold: they are still delivered to you. A shipment request you have not paid for is canceled.
  • Seals are forfeited without payment. Seals are a license to use the site, never become Cash, and have no value outside it; spend them before you close. Seals set aside for a trade offer are returned to your balance first and forfeited with the rest, and so are Seals set aside for a bid on somebody else's auction.
  • Your profile is made private, and your username stays reserved; it cannot be taken by anybody else.
  • Cash, including the proceeds of the cards just sold, remains yours. After closing you are prompted to withdraw it, and the withdrawal page stays open to you for that purpose, subject to the 14-day hold on sale proceeds, the daily cap, review and identity verification, unless it was obtained by fraud or is subject to a chargeback or legal hold. Cash not withdrawn within the period set by the applicable unclaimed property law is treated as unclaimed property.

19. Intellectual property

19.1 Ours. The site, its design, its software, its text, the pack presentations and the fairness method are Sealed's or its licensors' and are protected by copyright and trademark law. You may use them only to use the site as these Terms allow.

19.2 The cards' owners. The names, likenesses, logos, artwork and trademarks on collectible cards belong to the card manufacturers, leagues, players, game publishers and grading companies. Sealed is not affiliated with or endorsed by any of them. Card images and descriptions are shown to identify the cards for sale.

19.3 Yours. You keep what you post — a profile, a chat message, a listing description. You give Sealed a license to show it on the site and in connection with the site for as long as it is there, and you promise you have the right to post it.

19.4 Copyright complaints. If you believe something on Sealed infringes your copyright, send a notice to our designated agent: Copyright Agent, Sealed Collectibles, Inc., 5794 Bird Rd, Unit 577, Miami, Florida 33155, or legal@sealed.live. The notice must identify the work you say is infringed and the material on Sealed you say infringes it, with enough detail for us to find it; give your name, address, telephone number and email address; state that you believe in good faith the use is not authorized by the owner, its agent or the law; state, under penalty of perjury, that the notice is accurate and that you are the owner or authorized to act for the owner; and carry your physical or electronic signature. We remove or disable access to material that is the subject of a valid notice, and close the accounts of repeat infringers in appropriate circumstances.

20. Third parties

Sealed relies on other companies to run: Clerk for sign-in, Stripe for payments and payouts, a licensed pricing provider for card identity and values, suppliers who hold and ship the cards, and the makers who fill shop orders. Each has its own terms, which apply to your dealings with them. Sealed is not responsible for their acts or omissions except as these Terms say. Stripe's onboarding, identity checks and tax forms are Stripe's.

21. Disclaimers

21.1 The site is provided as it is. Sealed makes no warranty that the site will be available, uninterrupted or error-free, and disclaims every implied warranty, including merchantability, fitness for a particular purpose and non-infringement, to the extent the law allows.

21.2 Collectibles carry risk. The value of a collectible card can fall. Market values shown on the site are estimates for the site's own purposes, not advice, and may be wrong. Nothing on Sealed is investment advice, and Sealed is not a marketplace for investments.

21.3 Cards are described in good faith. A card's identity, grade and value come from its supplier, the grader and a licensed provider. If any of them is wrong, section 7.5 says what Sealed will do, and that is the whole of Sealed's obligation.

21.4 Sealed is not a casino and does not offer gambling. Packs contain collectible trading cards at published odds. The sweepstakes is a promotional sweepstakes with a free method of entry.

22. Limitation of liability

To the extent the law allows, Sealed and the people who run it are not liable to you for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost data or lost value of a collectible, arising from the site or these Terms, however caused. Sealed's total liability to you for everything arising from the site in any twelve-month period is limited to the greater of the amount you paid Sealed in that period and $100. Some states do not allow some of these limits, in which case they apply only as far as the law permits.

23. Indemnity

You will defend and indemnify Sealed against claims, losses and costs, including reasonable attorneys' fees, arising from your breach of these Terms, your content, or your unlawful use of the site.

24. Disputes

24.1 Talk to us first. Before either of us starts an arbitration or a court case, the one with the complaint sends the other a written notice: to Sealed at Sealed Collectibles, Inc., 5794 Bird Rd, Unit 577, Miami, Florida 33155, or legal@sealed.live; to you at the email address on your account. The notice gives your name and that email address, describes the problem, and says what you want. We then have 60 days to resolve it, and if either of us asks, we meet by phone or video call to try, with you taking part personally (your lawyer may join). A notice that leaves these out does not start the 60 days. Any time limit for bringing the claim is paused from the notice until the 60 days end.

24.2 Arbitration. Any dispute between you and Sealed that is not resolved under 24.1 will be settled by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small claims court, and either of us may go to court to stop the infringement or misuse of intellectual property. The Federal Arbitration Act governs this section. A hearing, if there is one, is held by video or phone, or in the county where you live. Fees are paid as the AAA's Consumer Arbitration Rules provide. You and Sealed each give up the right to a jury trial. The arbitrator decides every question about the dispute, including whether it must be arbitrated, except that a court decides whether 24.4 and 24.5 are valid and how they apply.

24.3 Opting out. You may opt out of arbitration by emailing legal@sealed.live, or writing to the address in 24.1, within 30 days of first accepting these Terms. Send it from, or include, the email address on your account, and say that you opt out of arbitration. Opting out changes nothing else in these Terms, and Sealed keeps a record of every opt-out it receives.

24.4 No class actions. Disputes will be resolved only on an individual basis, and neither of us may bring or join a class, collective or representative action, in arbitration or in court. If a court decides that this section cannot be enforced for a particular claim or remedy (such as a claim for public injunctive relief), that claim or remedy, and only that one, is decided by a court after the arbitration of everything else is finished.

24.5 Mass filings. If 25 or more demands for arbitration that raise substantially similar claims are filed against Sealed, or by Sealed, by or with the help of the same or coordinated lawyers or organizations, they are handled as follows, under the AAA's Mass Arbitration Supplementary Rules where those apply:

  1. Test cases first. The claimants' lawyers and Sealed each choose 10 of the demands, and those 20 proceed first. The rest are held: they are not administered, and no fees are due on them, until their turn comes.
  2. Then a mediation. After the 20 are decided, the claimants and Sealed take part in a mediation of the remaining claims for at least 30 days, with the mediator's fee paid by Sealed.
  3. Then in batches. Remaining demands not resolved proceed in batches of up to 100, with each batch decided by a single arbitrator where possible, and fees for a batch due only when it proceeds.
  4. Time limits paused. Any time limit for bringing a held claim is paused from the day the claim is filed until its batch proceeds.

A court may enforce this section, including by stopping fees from being charged on held demands.

24.6 Governing law. These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules. Where a dispute is not subject to arbitration it will be heard in the state or federal courts located in New Castle County, Delaware, and you consent to their jurisdiction.

25. Changes to these Terms

We may change these Terms. When we do, we will post the new version with its date and, for a change that materially affects you, tell you by email or on the site at least 14 days before it takes effect, except where a change is required by law or is needed to address fraud or abuse, in which case it may take effect at once. Using the site after a change takes effect means you accept it. The version you accepted is recorded with your account. A change does not alter the terms of a listing, auction, trade, break, shipment or shop order that was already in progress.

26. General

26.1 The whole agreement. These Terms, the Privacy Policy, the Official Rules and, for creators, the creator agreement are the entire agreement between you and Sealed about the site.

26.2 Severability. If a part of these Terms is found unenforceable, the rest stays in force and the part is read as narrowly as needed to make it enforceable.

26.3 No waiver. Sealed's not enforcing a term is not a waiver of it.

26.4 Assignment. You may not assign these Terms. Sealed may assign them to a successor of the business, and will tell you if it does.

26.5 Notices. Notices to you go to the email address on your account or are shown on the site. Notices to Sealed go to Sealed Collectibles, Inc., 5794 Bird Rd, Unit 577, Miami, Florida 33155, or legal@sealed.live.

26.6 Contact. Support is at sealed.live/support. Sealed Collectibles, Inc., 5794 Bird Rd, Unit 577, Miami, Florida 33155.

26.7 Errors and corrections. If a system error gives you something you were not meant to have — a pull, a card, Seals, Cash, an entry or experience points that the site's rules did not produce, or a price or balance shown or applied wrongly — Sealed may correct it, by reversing it or putting your account where the rules would have left it, and will tell you when it does. If an error takes something from you, Sealed will correct that too.

26.8 Survival. Sections that by their nature should outlast the end of your account or of these Terms do, including 4.7, 5, 18.3, 19, 21, 22, 23 and 24, and any amount either of us owes the other.

26.9 Events outside our control. Sealed is not responsible for a delay or failure caused by something outside its reasonable control, such as a natural disaster, an outage at a provider Sealed relies on (section 20), a carrier's failure, a strike, or an act of government.

26.10 Electronic communications. You agree to receive these Terms, notices, receipts and other communications from Sealed electronically, by email to the address on your account or on the site, and agree that they satisfy any requirement that they be in writing. Messages about new packs, drops and offers are separate: you choose whether to receive them, and can change your mind in your account settings.

27. The shop

27.1 What the shop sells. The shop sells Sealed merchandise and accessories for storing cards. These are ordinary goods. They are not cards, they are not pulled, there is nothing uncertain about what arrives, and nothing in the shop is a prize.

27.2 Who makes it. Merchandise is made to order for you by a print partner after you place the order. Accessories are shipped by a supplier. Sealed holds no stock of either, and neither is made or shipped by Sealed itself — the same arrangement as the cards, and the same disclosure.

27.3 Paying. You pay in Seals, at the price shown. Shipping is charged in Seals as well, worked out before you pay and shown to you with the total. As with everything else on the site, spending Seals earns no sweepstakes entries; entries are earned when you buy Seals, under section 14.

27.4 One order per maker. An order containing both merchandise and accessories is placed as two orders and arrives as two packages, each with its own shipping. You are told this before you pay.

27.5 Returns. Merchandise is made to order, so it cannot be returned because you have changed your mind. If an item arrives faulty, damaged or not what you ordered, tell Sealed within 30 days of delivery and Sealed will replace it or refund you in Seals. Accessories may be returned unopened within 30 days for a refund in Seals; you pay the return shipping unless the item was faulty or wrong.

27.6 Canceling. Sealed may cancel a shop order before it ships — if the maker cannot fulfill it, for instance. If it does, the Seals you paid are refunded in full. A shop order earns no sweepstakes entries, so none are affected.

27.7 Sales tax. Sealed does not calculate, show or collect sales tax on a shop order. Where its makers charge Sealed tax on what Sealed buys from them, Sealed bears it, and no part of it is charged on to you.

27.8 Shipping. The shop ships within the United States only. Delivery estimates come from the maker or the carrier and are estimates, not promises.
